1. Introduction

Welcome to our world. In Greece we say ‘clean deals make good friends’ and
this is what we are aiming to be with you as well. Please read these terms of
business carefully, they relate to Gaia Pulses subscriptions supplied to you
through our website and should be read in conjunction with our Privacy Policy
which shall also apply.

You will be asked to expressly agree to these terms of business before you
subscribe to Gaia Pulses from our website.

2. Information about us

Our full name is Gaia Pulses ltd. We are registered in England and our
registered office is 1/106 Schwartz Wharf, E95GS. Our company registration
number is 11445280.

3. Order process

For the steps you need to take in order to sign up to Gaia Pulses, please see
our Website. The minimum order is the weekly subscription to the 1lt stew
delivered in one of the Gaia Pulses flasks. You must be at least 18 years of age
(or a business operated by someone at least 18 years of age) to buy a Gaia
Pulses subscription.

Our order process allows you to check and amend any errors before
submitting your order to us. Please take the time to read and check your order
at each page of the order process.

After you sign up and create your account, you will receive an email from us
confirming your order (“Confirmation”).  The Contract between us will only be
formed when we send you the Confirmation. 

Occasionally, we may be out of stock of a particular meal or ingredients and in
this case, we reserve the right to substitute an alternative dish within our
menu. We will email you in advance if this is the case and advise you of the
allergens list.

4. The Gaia Pulses dishes are set out on our website.

If you suffer from any food allergies, please check the ingredient list for your
chosen meal for any allergens and fill up the box in the check out asking you if
you have any allergies. If you are in any doubt, please do contact us BEFORE
DELIVERY.

Your Gaia Pulses dishes and other products will be delivered in re-usable
containers, flasks, jars, bottles, bags and tote bags that will be collected with
your next Gaia Pulses delivery. Please ensure that all of the reusable
containers are washed, dried and placed in the Gaia Pulses tote bag before
collection. Storage, cooking and re-heating instructions must be followed
closely.

The companies we work with

We are giving you the option in addition to the Gaia Pulses dishes to also
purchase bread via our service. Although we have carefully selected the E5
bakery for their distinct quality, we do not carry any responsibility for any
allergies or other issues that may occur from the consumption of these
products as we have no way of controlling their production process.

5. Price and payment

Prices for our Gaia Pulses stews and extra products (bread, Kombucha, kimchi
etc) are quoted on our website.

You will not be asked to pay anything for the reusable containers but you are expected to return them each week upon receiving your new order. In the case any containers or reusable items are missing for 3 weeks in the row, you will be sent an invoice with the price of those containers. The fee will not be refundable. If you decide to stop the service you are required to return all of the reusable containers to us via the usual handover procedure.

Payment for your selected meal and extras are automatically being deducted
on the Monday following your order. We may withhold the Gaia Pulses
deliveries and/or cancel the contract between us if the payment is not received
from you in full in cleared funds. We may also interrupt serving you if you are
continuing to not return the reusable containers back to us.

The prices on the website include all value added taxes (where applicable). 

Your Gaia Pulses service will continue automatically and payment will be
collected on Friday in the week of your delivery unless you notify us before
Thursday midnight when it is our cut off day for the following week’s orders that
you wish to cancel in accordance with clause 7 below. Prices for Gaia Pulses
are liable to change at any time, but changes will not affect orders that have
already been placed and we will give you advance warning if our prices are
likely to change.

6. Delivery policy

We deliver only to the postcodes listed on our website. All orders are delivered
by our bicycle couriers between 11am and 6pm. Please let us know if you are
not going to be in and we can leave it in your preferred spot. 

Please be aware that by signing up you agree for your phone number to be
passed on to our cyclists OR bicycle Delivery Company. Neither they nor Gaia
Pulses will use your personal information for anything other than the intended
purpose, which is to ensure your Gaia Pulses order gets to you in time. 

If you have entered alternative delivery instructions (for example “leave with a
neighbour” or “leave in shed”) then this is entirely at your own risk and you
will be responsible if the Gaia Pulses bag goes missing and you will be liable
for paying the costs of the containers. It is agreed that anyone at the delivery
address is entitled to accept delivery.

If you are not at home when we deliver, and we can’t find a safe space to leave
your delivery, and we have not been informed by you about an alternative drop
off, we will need to return the Gaia bag to our headquarters and you will not be
refunded in this event. If we can find a safe space to leave it, we’ll take a photo
and email you so you know where that is.

Serving or Storing

If you are planning to eat directly, you can serve the hot stew straight from the
thermos into your bowls. If you would like to eat it later, we recommend
emptying the food from the thermos in an open non plastic container until it
cools down (1 hour) and then put it in a Tupperware the fridge. It keeps well for
6-7 days as long as you don’t reheat the same portion more than once or
maximum twice. You also have the option of freezing the food. It will be good
for 3 months. Please note we cannot accept liability for any deliveries that are
left out or uneaten for longer than our recommendations.

Edit, Skip or Cancel

Through your profile on the Gaia Pulses website or by emailing us at
info@gaiapulses.co.uk, you may select to skip a week’s delivery, edit your
order or cancel. All that incurs no costs provided you inform us before the cut
off which is at midnight on Thursday prior to the week of the scheduled delivery.

You will need to select this option for every applicable item in your subscription individually.

The time that your order is delivered will vary week on week depending on
traffic, weather and the number of deliveries to be made that day. If ordering
regularly, you may notice that your delivery occurs at a similar time each week,
however, we make no guarantee of this time and accept no liability for
inconvenience or loss as a result of a deviation from it.

If you are going to be away on holiday and wish to pause the delivery, please
email us or log into your account and your subscription will be paused until
your return.

7. Changing your mind and cancellations 

Changing your mind: You may cancel your contract with us at any time by 12
midnight on the Thursday prior to your delivery date by writing to us at:
info@gaiapulses.co.uk or through your profile. We will not take any
further payments from you and in order not get charged for the containers as
long as you return them via the usual handover within 3 weeks of the end of
your subscription and the contents of the tote bag are not damaged and in
good condition. Alternatively you may return them to our premises in 4 Schwartz Wharf, London, E9 5AA

Due to the perishable nature of the food you do not have a right to change your
mind after delivery of the Gaia Pulses meals under the Consumer Contracts
Regulations.

In the unlikely event that you are not satisfied with the quality of the meal or
have any other complaint, please do contact us right away. All refunds will be
entirely at our discretion.

8. Statutory rights

Nothing in these terms of sale affects your statutory rights (including your
right to receive a refund in respect of any defective product we sell to you).

9. Refunds and exchanges

Orders close and you are billed at 12:01am on Fridays - you must contact us
before this time to skip your order the following week to avoid being charged. If,
due to unforeseen circumstances, you need to cancel on a Friday you
may be eligible for a 50% refund. We’re sorry but cancellations on Saturdays onwards are not eligible for any refund but you could redirect your delivery and gift a nearby neighbour. All refunds will be entirely at our discretion.

If you cancel your contract and are entitled to a refund, we will usually refund
any money received from you using the same method originally used by you to
pay for your purchase. We will process the refund due to you as soon as
possible and, in any event, within 30 days of the day we received your valid
notice of cancellation.

10. Limitations and exclusions of liability

Nothing in the terms of sale will: (a) limit or exclude the liability of a party for
death or personal injury resulting from negligence; (b) limit or exclude the
liability of a party for fraud or fraudulent misrepresentation by that party; (c)
limit or exclude any liability of a party under Section 12, 13, 14 or 15 of the Sale
of Goods Act 1979 or Part I of the Consumer Protection Act 1987; (d) limit or
exclude any liability of a party in any way that is not permitted under applicable
law.

We will not be liable to you in respect of any losses arising out of any event or
series of events beyond our reasonable control.

We will not be liable to you in respect of any business losses, such as loss of
or damage to profits, income, revenue, use, production, anticipated savings,
business, contracts, commercial opportunities or goodwill.

11. Other important terms

We will treat all your personal information that we collect in connection with
your order in accordance with the terms of our privacy policy; use of our
website will be subject to our website terms of use.

This contract is between you and us. No other person shall have any rights to
enforce any of its terms.

Each of the paragraphs of these terms operates separately. If any court or
relevant authority decides that any of them are unlawful or unenforceable, the
remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these terms,
or if we do not enforce our rights against you, or if we delay in doing so, that
will not mean that we have waived our rights against you and will not mean
that you do not have to comply with those obligations. If we do waive a default
by you, we will only do so in writing, and that will not mean that we will
automatically waive any later default by you. 

If you are a consumer, please note that these terms are governed by English
law. This means a Contract for the purchase of Gaia Pulses through our site
and any dispute or claim arising out of or in connection with it will be governed
by English law. You and we both agree to that the courts of England and Wales
will have non-exclusive jurisdiction. However, if you are a resident of Northern
Ireland you may also bring proceedings in Northern Ireland, and if you are a
resident of Scotland, you may also bring proceedings in Scotland

12. Communications between us

When we refer to "in writing" in these terms, this will include e-mail.
If you wish to contact us in writing for any reason, you can write to us by e-

If we have to contact you or give you notice in writing, we will do so by e-mail
or by pre-paid post to the address you provide to us in your order.

Any change to your details must be notified to us promptly, either by updating
your details via your account on the website or by calling our customer
services team on the number detailed on the website.
